1. About these Terms
These Terms of Service ("Terms") form a binding agreement between you and Arm Financial Services Pty Ltd (ABN 21 643 318 012), trading as ARM Financial ("ARMF", "we", "us"). They govern your use of the marketing website at armf.com, your registration for an ARMF account, and your use of any financial product or service we provide (the "Services").
These Terms must be read together with our Privacy Policy and any product-specific terms we present to you when you apply for a particular Service.
2. Eligibility and Acceptance
By using armf.com you agree to the parts of these Terms that apply to website use. By creating an ARMF account you agree to all of these Terms. To open or operate an ARMF account you must:
- be at least 18 years old;
- be a resident of a country in which we offer the Services;
- have the legal capacity to enter into a binding contract; and
- not be subject to any sanctions or other legal restriction that prevents us from providing Services to you.
We may refuse to open an account, or close an existing account, where we consider it necessary to comply with law, manage risk, or protect the integrity of the Services.
3. Use of the Marketing Website
You may browse armf.com, read our blog, subscribe to our newsletter, and contact us. You agree to use the website only for lawful purposes. You agree not to:
- attempt to gain unauthorised access to any part of the website or its systems;
- use bots, scrapers, or other automated tools to extract content beyond what is permitted by our
robots.txt; - introduce viruses or other malicious code;
- misrepresent your identity or use the contact form to send spam or unlawful content;
- reproduce or republish substantial portions of the website without our prior written consent.
4. Account Registration and Identity Verification
ARMF is a regulated financial-services provider. Before you can use the Services we are required to verify your identity and conduct ongoing customer due diligence under the AML/CTF Act 2006 (Cth). You agree:
- to provide accurate, current, and complete information during onboarding and to keep it up-to-date;
- to provide documents and information we reasonably request to verify your identity, source of funds, and the purpose of your transactions;
- to consent to identity, sanctions, and PEP screening checks carried out by us or our service providers; and
- that we may re-verify your identity at any time during the relationship.
5. The Services
The Services may include multi-currency accounts, domestic and international transfers, foreign-exchange (FX) conversions, card products, and related features, depending on your jurisdiction and account type. The features available to you depend on your verification level, your country of residence, and applicable law. We may add, modify, or discontinue Services from time to time on reasonable notice.
6. Payment Instructions, Fees and FX
When you submit a payment instruction you authorise us to debit your ARMF balance (or funding source) for the amount of the payment plus any applicable fees and FX margin. Our current fees and rates are shown to you before you confirm a transaction.
- Payment instructions are typically irrevocable once submitted, except as required by law or scheme rules.
- You are responsible for ensuring beneficiary details (name, account number, IBAN, bank, country) are correct. We are not liable for losses caused by incorrect beneficiary information you provide.
- We may delay, hold, or refuse a payment where we reasonably suspect fraud, sanctions exposure, or breach of these Terms.
- We may change our fees on at least 30 days' notice, except where the change is to your benefit or required by law.
7. Prohibited Uses
You must not use the Services to:
- commit or facilitate any illegal activity, including money laundering, terrorism financing, fraud, tax evasion, or sanctions evasion;
- transact with sanctioned individuals, entities, or jurisdictions;
- operate a money-services or payment-aggregation business on top of an ARMF personal account;
- process transactions on behalf of another person without our prior written consent;
- provide false, misleading, or out-of-date information; or
- circumvent any limit, control, or security feature of the Services.
Breach of this Section may result in immediate suspension or closure of your account, reversal or freezing of transactions, and reporting to authorities.
8. Suspension, Termination and Closure
You may close your ARMF account at any time, subject to completing or unwinding any pending transactions. We may suspend or close your account on reasonable notice, or immediately if required by law, regulation, or scheme rule, or if we reasonably suspect fraud, AML/CTF risk, sanctions exposure, or material breach of these Terms.
On closure we will return any remaining balance to a verified account in your name, less any amounts we are entitled to retain. Where applicable law requires, unclaimed balances may be remitted to the relevant authority.
9. Customer Security Obligations
You are responsible for:
- keeping your login credentials, passcodes, and devices secure;
- enabling and using multi-factor authentication where offered;
- not sharing access to your account with any third party;
- notifying us immediately if you suspect unauthorised access (email security@armf.com); and
- only acting on payment requests after independently verifying the recipient through a trusted channel.
10. No Financial, Investment, Legal or Tax Advice
Content on this website and within the platform, including blog posts, FAQs, and comparisons, is general information only. It is not financial product advice, investment advice, legal advice, or tax advice, does not take into account your objectives or financial situation, and should not be relied on as such. You should obtain advice from a licensed professional before making any financial decision.
11. Intellectual Property
All content on armf.com and within the platform, including text, graphics, logos, and software, is owned by ARMF or its licensors and is protected by intellectual-property laws. The ARM Financial name and logo are trade marks of ARMF. We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to access and use the website and the Services for your own personal or internal business use. You must not copy, modify, distribute, or reverse-engineer any part of the Services without our prior written consent, except as expressly permitted by law.
12. Service Availability, Disclaimer and Limitation of Liability
We aim to keep the website and Services available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part for maintenance, security, or legal reasons. We are not liable for delay or failure caused by events beyond our reasonable control.
To the maximum extent permitted by law, the website and Services are provided "as is" and "as available" without warranties of any kind. We will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenue. Where our liability cannot lawfully be excluded but can be limited, our total aggregate liability to you for all claims arising in any 12-month period is capped at the greater of (a) the fees you paid us for the Services giving rise to the claim during that period, or (b) AUD 100. Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded under the Australian Consumer Law.
13. Complaints and Dispute Resolution
If you have a complaint, please contact us first at complaints@armf.com. We will acknowledge your complaint within 7 days and aim to provide a final response within 30 days, in line with ASIC Regulatory Guide 271.
If you are not satisfied with our final response, you may escalate to the Australian Financial Complaints Authority (AFCA): www.afca.org.au or 1800 931 678. AFCA provides a free, independent dispute-resolution service. Privacy-related complaints can additionally be made to the OAIC (see our Privacy Policy).
14. Governing Law and Changes
These Terms are governed by the laws of the State of Victoria, Australia. You and ARMF submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising out of or in connection with these Terms.
We may update these Terms from time to time. Material changes will be indicated by updating the "Last updated" date above, and where the change is significant we will give at least 30 days' notice (by email, in-app banner, or push notification). Your continued use of the website or Services after the effective date constitutes acceptance of the revised Terms.
